Terms of service
These terms are an agreement between you and Kalam Enterprises ("EatzyGo", "we", "us"), registered office at Shop No. 1, Jameel Manzil, Near Tanwar Complex, Kausa, Mumbra 400612, Maharashtra, India. By creating an account or placing an order you accept these terms and our privacy policy.
1. What EatzyGo is
EatzyGo is a platform that connects customers with independent restaurants and shops ("store partners") that prepare and sell food, and with independent delivery partners who deliver it. EatzyGo does not prepare food. Store partners are responsible for the quality, safety, hygiene, ingredients and legal compliance (including FSSAI licensing) of what they sell. Menu information, including prices, images and dietary descriptions, comes from the store partner.
2. Eligibility and your account
- You must be at least 18 years old, or use the service with the consent and supervision of a parent or lawful guardian.
- You must give accurate registration details (name, phone number, email address) and keep them up to date.
- You are responsible for activity under your account. Keep your password and any one-time codes confidential. EatzyGo staff will never ask you for them.
- We may suspend or close accounts that break these terms, commit fraud or abuse, or misuse offers.
- You can delete your account at any time. The account and data deletion page explains how, and what happens to your data.
3. Ordering and payment
- When you place an order you make an offer to buy from the store partner. The order is confirmed when the store accepts it.
- All prices are in Indian rupees (INR). Item prices, taxes (including GST), delivery fees, packaging charges and any platform fees are shown at checkout before you pay.
- Online payment is processed by Razorpay (cards, UPI, net banking and wallets, as available). You enter your payment details in Razorpay's checkout. EatzyGo does not receive or store them.
- Cash on delivery may be offered for eligible orders and locations. Pay the exact order amount to the delivery partner. We may withdraw cash on delivery from accounts with repeated refused deliveries.
- If a payment is debited but the order is not confirmed, the amount is refunded to the original payment method within the time Razorpay and your bank take to process it.
4. Cancellations and refunds
- Cancelling an order: you may cancel free of charge before the store accepts your order. Once the store has accepted, preparation starts, and we may be unable to cancel or may charge you for items already prepared.
- Cancellation by the store or by us: if the store cannot fulfil the order (an item is unavailable, the store has closed, or no delivery partner is available), we cancel it and refund any online payment in full.
- Refund requests: you may ask for a refund or replacement if an order is not delivered, is substantially wrong (wrong items), or has a verifiable quality problem. Report it through in-app support soon after delivery, with details and photos where you have them.
- Refund method and time: approved refunds go back to the original payment method, or to platform credit where you agree. We initiate the refund once approved; Razorpay and your bank then take their usual processing time, typically 5 to 7 working days. Approved refunds for cash on delivery orders are paid as platform credit or bank transfer.
- We may decline refund requests that show a pattern of abuse.
5. Delivery
- Delivery times shown in the app are estimates, not guarantees. Actual times depend on preparation, distance, traffic, weather and delivery partner availability.
- You must give an accurate delivery address and be reachable on your registered phone number or through the in-app chat. If delivery fails because the address is wrong or you cannot be reached, the order may be treated as delivered or cancelled with the applicable charges.
- Risk in the food passes to you on delivery. Check your order at handover where you can.
- Deliveries are made by independent delivery partners. EatzyGo coordinates them and shows you the delivery partner's live position, but does not itself transport goods.
6. Your conduct
You agree not to:
- abuse, harass or threaten delivery partners, store staff or support staff, in person or in the in-app chat;
- place fraudulent orders, misuse promotions or referrals, or create multiple accounts to exploit offers;
- submit false refund claims, fake reviews or misleading content;
- reverse engineer, scrape or interfere with the platform, or use it for any unlawful purpose;
- use another person's account or payment instrument without permission.
Breaches may lead to cancelled orders, withheld refunds, suspension or closure of your account, and a report to the authorities where the law requires.
7. Store partners and delivery partners
Store partners and delivery partners use the platform under separate partner agreements with EatzyGo. They are independent businesses or independent contractors, not employees or agents of EatzyGo. Commissions, payouts, service standards and document checks are set out in those agreements. Nothing on this page creates an employment or agency relationship.
8. Reviews and content you submit
When you submit a rating, review or chat message you grant EatzyGo a non-exclusive, royalty-free licence to store, display and moderate it on the platform. Do not post content that is false, defamatory, obscene or infringes anyone's rights. We may remove content that breaks these terms.
9. Intellectual property
The EatzyGo name, logo and apps, and their content other than partner and user content, belong to or are licensed to Kalam Enterprises and are protected by law. Do not use them without our prior written permission.
10. Disclaimers and limitation of liability
- The platform is provided "as is" and "as available". We do not promise uninterrupted or error-free operation.
- EatzyGo is not liable for the acts or omissions of store partners (including food quality, hygiene or allergen accuracy) or for delays outside our reasonable control.
- To the extent the law allows, EatzyGo's total liability for any claim arising from an order is limited to the value of that order, and EatzyGo is not liable for indirect, incidental or consequential losses.
- Nothing in these terms excludes liability that cannot be excluded under Indian law, including your rights under the Consumer Protection Act, 2019.
11. Indemnity
You agree to indemnify EatzyGo against claims, losses and expenses that arise from your breach of these terms, your misuse of the platform, or your violation of applicable law or of another person's rights.
12. Governing law and disputes
- These terms are governed by the laws of India.
- If you have a complaint, first contact us at contact@eatzygo.in or our grievance officer, Umair Shaikh, at the same address. We acknowledge complaints within 48 hours and aim to resolve them within one month, as the Consumer Protection (E-Commerce) Rules, 2020 require.
- Subject to any consumer-protection remedies the law gives you, disputes we cannot resolve between us are subject to the exclusive jurisdiction of the courts at the place of our registered office in India.
13. Changes to these terms
We may update these terms. We will tell you about material changes through the app and update the effective date at the top of this page. If you keep using the service after a change takes effect, the updated terms apply.
